What you can do is see another orthopedic surgeon for an evaluation, bringing along your surgical and injury reports, and a physical therapist. There is probably some solution to your problems. I don't think you can sue her either. Usually, patients have to sign a consent for surgery and the doctor can do whatever they deem necessary or in the best interest of the patient.
